Francesca Albanese, the United Nations Special Rapporteur on the Occupied Palestinian Territories, has raised serious concerns about India’s ongoing political and defence ties with Israel, suggesting that such relations could potentially violate international law. In an interview, she referred to legal principles linked to the International Court of Justice, which, according to her interpretation, place obligations on countries to avoid military and trade relations with states accused of maintaining illegal occupation.
Albanese presented her findings in a report titled “Torture and Genocide,” submitted to the United Nations Human Rights Council. In the report, she alleged that Palestinians have faced systematic torture since October 2023, particularly in Gaza. The report describes the region as functioning like a “vast torture camp,” citing large-scale arrests, including minors, and thousands of reported disappearances. It also highlights allegations of harsh detention conditions, abuse, and lack of basic rights.
Speaking about India, Albanese said that maintaining close engagement with Israel, especially in defence and political areas, could risk breaching international obligations. She noted that continued cooperation might contribute to what she described as a broader system of violence. According to her, such actions could also weaken the global legal framework that governs international relations.
She further argued that torture is not an isolated issue but part of a wider system. In her view, these practices extend beyond prisons and are reflected in daily life through surveillance, restrictions, and control over movement in Palestinian territories. The report claims that these measures create an environment of constant pressure and coercion.
Albanese also linked her concerns to broader global accountability, stating that some countries have already taken steps to address similar issues through legal or diplomatic actions. She called on the international community to uphold legal standards and ensure accountability where violations are alleged.
Her remarks have added to ongoing international debate over the situation in Gaza and the responsibilities of countries maintaining ties with Israel. The issue remains sensitive and complex, involving legal interpretations, diplomatic relations, and differing global perspectives on the conflict.
