Vietnam's Guidelines on Land Clearance Prior to Project Approval

Vietnam has delineated clear regulations on land clearance concerning construction projects, addressing the pivotal issue of timing for land acquisition and site preparation in relation to project approval. Officials have established that the legal basis for land acquisition, compensation, site clearance, and resettlement activities hinges on the approval of investment projects.

This clarification comes in response to concerns about the practice of initiating land clearance before formal project approval. The Ministry of Construction has articulated that existing laws delineate a precise order for project implementation, encompassing preparation, execution, and completion phases.

According to the provisions of the 2014 Construction Law, project preparation documentation, which includes both pre-feasibility and feasibility studies, must outline comprehensive details concerning land use and site clearance strategies. These evaluations are crucial in ensuring that a project’s viability and effectiveness are assessed prior to approval.

Officials also underscored that land acquisition and allocation steps are primarily required to take place only after a project receives approval and an investment decision is sanctioned. This process ensures that all land-related activities align with the officially authorized project timelines and plans.

Nevertheless, the legal framework does provide for certain exceptions. Under the Law on Public Investment of 2024, qualified authorities are empowered to treat land clearance, compensation, and resettlement as distinct components of the project. This allows these activities to be conducted separately from the main construction investment initiative.

This flexibility is particularly beneficial for large-scale or urgent undertakings, enabling early land clearance as a means to adhere to development schedules. It enhances project execution efficiency while remaining within legal boundaries.

In summary, this clarification underscores the necessity of adhering to correct procedures in construction investments, while also providing specific allowances to facilitate swift infrastructure advancement across Vietnam.
