Madhesh Ravichandran, hailing from Tamil Nadu, took legal action against his manager, who is a Sri Lankan Tamil, for subjecting him to constant racial abuse and biased treatment. During the tribunal proceedings, Ravichandran disclosed instances of his manager employing racially charged insults, including derogatory terms like "slave" and claims that "Indians are fraudsters." This behavior was not sporadic; it constituted a systematic trend of discrimination that adversely affected his work life and self-respect.
After a thorough review of the evidence, the tribunal ruled decisively in favor of Ravichandran, determining that he indeed experienced direct racial discrimination. It was noted that requests for time off were specifically declined due to his Indian background, while leave requests from Sri Lankan Tamil employees were prioritized. Not only did he encounter rejection of his holiday requests, but Ravichandran also endured ongoing racial harassment and was coerced into working excessive hours.
The situation took a turn when his manager mandated long and arduous shifts, leading to Ravichandran's dismissal without proper notification, which is a clear infringement of employment rights. The tribunal deemed this termination to be wrongful and unfounded. Consequently, Nexus Foods Limited, the franchise's operating entity, was instructed to compensate Ravichandran with almost £67,000, covering damages for racial discrimination, outstanding holiday pay, and remuneration for the notice period he should have received.
In addition to the financial compensation, the tribunal required Nexus Foods Limited to conduct comprehensive anti-discrimination training for all staff members, aiming to enhance their capability to manage grievances related to discrimination, thereby promoting a safer, fairer workplace for all employees.
