In a surprising statement, former President Donald Trump asserted that all official documents signed by Joe Biden via an autopen are “null, void, and of no further force or effect.” This declaration, made on Trump’s Truth Social platform, has sparked renewed discussions about presidential powers and the use of automated signature devices within the White House.
The autopen, a device that accurately replicates a person’s signature, has been utilized by presidents from both major parties for many years. Trump criticized Biden for using it, suggesting that it indicates the president is not completely in control of his administration. “All Documents, Proclamations, Executive Orders, Memorandums, or Contracts, signed under the now notorious 'AUTOPEN,' in the administration of Joseph R. Biden Jr., are declared null, void, and of no further force or effect,” Trump stated.
He also cautioned individuals who received pardons or other legal documents signed using the autopen to regard them as entirely void. Trump’s remarks come amidst his ongoing critiques of Biden’s cognitive abilities and capacity to fulfill executive responsibilities, often citing the use of the autopen as a sign of administrative delegation.
However, using the autopen has been a common practice for many past presidents, including Barack Obama and even Trump himself, particularly during busy periods or while away from the White House. Critics of Trump’s assertion argue that the autopen does not affect the legal validity of executive orders or other presidential documents.
Adding to the drama, Biden’s last hours in office featured numerous preemptive pardons for notable figures and family members. These included individuals such as General Mark Milley, Dr. Anthony Fauci, and several members of Congress involved in January 6 investigations, along with Biden’s siblings and their partners. These clemency decisions were interpreted as protective steps to shield allies and family members from potential legal repercussions from the incoming administration.
Trump’s declaration has ignited discussions among legal experts and political analysts about the extent of a former president’s authority over the legitimacy of official documents. While largely symbolic, this announcement highlights the deep political rifts and ongoing debates surrounding executive power in the United States.
