Former PM Najib Razak's House Arrest Request Denied by Malaysian Court

A Malaysian court has issued a definitive ruling underscoring the significance of legal processes and accountability. On Monday, the High Court in Kuala Lumpur rejected former Prime Minister Najib Razak’s plea to serve the remainder of his prison term under house arrest.

Najib has been incarcerated since August 2022 following his conviction in the high-profile 1Malaysia Development Berhad (1MDB) corruption scandal, which involved the misappropriation of substantial public funds and severely undermined trust in Malaysia’s governance. Since being sentenced, Najib has made several legal attempts to modify or lessen his imprisonment conditions.

In this recent endeavor, Najib argued that a royal decree issued last year permitted him to complete his sentence outside of prison. He contended that this decree was part of a royal pardon granted by Malaysia’s former monarch and urged the court to compel authorities to comply with it.

However, the High Court concluded that the decree could not be put into effect. Judge Alice Loke clarified that while the existence of the royal document was acknowledged, it was not issued in accordance with appropriate legal protocols. According to Malaysian law, any decisions regarding pardons or changes in sentencing must go through the country's pardons board. The judge stated that the former king should have consulted this board prior to issuing such an order.

Due to this critical oversight, the court deemed the order invalid. Consequently, Najib will continue his sentence in prison rather than in a home setting.

This ruling comes at a pivotal time for Najib, as another court is set to announce a judgment later this week in what is regarded as his most significant trial related to the 1MDB case. This ruling could have further implications for his legal and political future. Throughout the proceedings, Najib has consistently denied all charges linked to the 1MDB scandal.
