A family that lost three loved ones in a wrong-way crash on Highway 401 last year has filed a $25 million lawsuit against two police officers, the police boards, and the estate of the suspect involved.
Tragic Collision Details
The April 29, 2024, crash left Gokulnath Manivannan and his wife Ashwitha Jawahar, as the sole survivors. The collision claimed the lives of Manivannan’s parents and the couple’s three-month-old son. The multi-vehicle accident occurred during a police pursuit that began after an alleged liquor store robbery in Bowmanville, Ontario.
The suspect, driving the wrong way on Highway 401 in Whitby, about 50 kilometers east of Toronto, was also killed in the collision, which involved at least six vehicles.
Allegations Against Police
The lawsuit claims negligence on the part of the defendants, including Durham Regional Police, Ontario Provincial Police, the two officers involved, and the estate of the suspect.
The family argues that while the suspect drove with “wanton disregard” for their safety, the officers’ decision to pursue him on the highway was “reckless.” The lawsuit alleges the police failed to consider safer alternatives and did not provide adequate training or oversight for high-risk pursuits.
No statements of defense have been filed yet, and the allegations have not been tested in court. Durham Regional Police said the service is aware of the lawsuit but cannot comment on ongoing legal matters.
Criminal Charges Against Officers
Two Durham officers, Sgt. Richard Flynn and Const. Brandon Hamilton is facing criminal charges in connection with the collision, following an investigation by Ontario’s Special Investigations Unit (SIU).
Lawyer Lawrence Gridin, representing Flynn in the criminal case, declined to comment on the civil lawsuit.
Ongoing Impact on Survivors
The family’s statement of claim details the lasting physical and emotional toll of the crash. Both survivors have incurred medical costs, sustained permanent injuries, and experienced loss of income and earning potential.
The statement reads: “As a result of this accident and its aftermath, the Plaintiffs, collectively, have suffered and will continue to suffer horrific pain and suffering, loss of enjoyment of life, and loss of amenities from nervous shock, mental distress, and psychological trauma.”
They also note being unable to perform household chores or maintain their home due to the injuries.
Family Seeks Accountability and Review of Police Pursuits
Represented by lawyers Brad Moscato and Adam Wagman of Howie, Sacks & Henry LLP, the family is pushing for a thorough investigation and hopes the case leads to clearer rules for police pursuits.
The statement of claim emphasizes, “The family hopes that this heartbreaking event leads to a careful review of how and when pursuits are authorized, and that clear, consistent standards are always followed. Public safety must remain the top priority.”
