Justice Minister Sean Fraser has expressed willingness to amend Canada’s federal hate crime legislation to potentially encompass symbols associated with groups like the Ku Klux Klan.
Bill C-9, introduced in September, seeks to penalize the public display of symbols linked to designated foreign terrorist organizations, along with the Nazi swastika and SS bolts, if used to incite hate. Offenders may face sentences of up to two years.
During a Senate query, independent Sen. Paula Simons pointed out that the current bill does not address groups such as the KKK, allowing displays like burning crosses or nooses to go unregulated. Fraser clarified that the inclusion of “hateful symbols” was restricted to those on an official terror list to prevent political biases, yet he remains open to parliamentary suggestions.
He mentioned that any further groups identified by the public safety minister would automatically be integrated into the hate crime law. Fraser acknowledged the lack of a universally accepted definition of hate, suggesting that starting with foreign terrorist entities is a “safe bet.”
Currently, the Criminal Code in Canada does not provide a legal definition for a hate group. The RCMP categorizes them as organizations that target entire populations based on race, religion, ethnicity, sexual orientation, or other protected traits.
The proposed legislation allows for exemptions in scenarios such as journalism, education, and the arts, or when demonstrating the harms caused by such symbols. Fraser noted that this bill does not serve as a “blanket ban” and does not aim to suppress symbols like the Palestinian flag.
Civil rights advocates have cautioned that the bill might inadvertently criminalize peaceful protests or political expressions. It is currently being reviewed by the justice committee in the House of Commons, with the Senate planning to introduce amendments once it clears the House.
